Buffalo River Truss Product Warranty

Warranty Coverage

 

Buffalo River Truss, Inc. ("The Company") warrants to the original purchaser ("The Purchaser") that the steel trusses and similar products ("The Products") sold are free from defects in material and workmanship under normal use and service for a period of fifty (50) years from the date of purchase.

 

Transfer of Warranty

 

This warranty extends to the original owner ("The End-Customer") of the property on which The Products are originally installed for the remainder of the original warranty period. The Warranty is non-transferable.

 

Voided Warranty

 

  • Any and all modifications made to The Products without prior explicit written consent of The Company voids the warranty.
  • Installation of The Products into a non-permitted building voids the warranty.
  • Installation of The Products into a building or structure that is not stamped by a state-certified structural engineer voids the warranty.

Warranty Exclusions

 

This warranty does not cover any damage, defects, and costs resulting from or in any way attributable to:

  • Weather Exposure: Damage caused by exposure to weather conditions including but not limited to storms, hail, excessive heat or cold, or natural disasters.
  • Mishandling: Damage caused by mishandling of The Products, including but not limited to fall damage, impact damage, or any form of physical abuse.
  • Accidental damage: Accidental damage to The Products from The Purchaser or The End-Customer is excluded.
  • Improper Installation: Damage caused by improper installation or not following the installation instructions provided by The Company.
  • Fading Paint: The Products are delivered with a primer coat and will fade over time if the trusses are not painted further. Paint fading is excluded.
  • Damage from 3rd party Shipping: Any and all damage resulting from 3rd party shipping is excluded.
  • Labor: All labor costs to The Purchaser and The End-Customer resulting from the repair or replacement of The Product are excluded.

Intended Tolerance

 

Trusses are considered within tolerance when:

  • Length of truss, excluding overhang, is within + 0.25 to - 0.75 inches
  • Overhang is within +/- 0.25 inches

Tolerance violations must be reported before initial installation. This warranty does not cover tolerance violations after initial installation.

 

Receival Inspection

 

The Purchaser is responsible for inspecting The Product upon delivery. Once the Purchaser signs for the delivery of The Product, it is assumed to be defect free. Accidental damage and paint defects not reported during initial delivery, or within 24-hours from delivery are assumed to be damage free and with acceptable paint. The Purchaser may accept The Product and still report the damage.

 

Claim Procedure

 

To make a claim under this warranty, The Purchaser or The End-Customer must notify The Company in writing within 14 days of discovering the alleged defect. Please call or email Buffalo River Truss to begin the claim process. Include Work Order Number, description and photos & video (as needed).

Claim Approval Process

 

The Company may request photos and video of The Product as part of the Claim Approval Process. Further, The Company may send a representative to the site to inspect The Products. Once evidence is submitted, the Claim will be approved or denied within five (5) business days - federal holidays are excluded.

If The Purchaser or The End-Customer fail to submit requested documentation within two weeks’ time, The Company will close the claim with an automatic denial.

Inspection Fee

 

The Company reserves the right to charge The Purchaser or The End-Customer an inspection fee of $175 USD to cover costs incurred to validate the Claim. In the event that the Claim is rejected, an invoice may be issued for the inspection fee within 30 days of receiving the Claim.

Shipping Costs Excluded

 

The cost of shipping replacement parts and / or Product(s) is excluded from the Warranty.

Limit of Liability

 

THIS WARRANTY COVERS UP TO AND INCLUDING THE ORIGINAL COST OF REPAIR OR REPLACEMENT OF THE PRODUCTS. ANY DAMAGE OR INJURY BEYOND THE COST OF THE PRODUCTS IS EXCLUDED FROM THIS WARRANTY.

Force Majeure (Acts of God)

 

The Company shall not be responsible or liable for damage, failure, or other detrimental issues hereunder when caused by, related to, or arising out of acts of God, weather, national, regional, or local disasters, calamities, or catastrophes, governmental restrictions, orders, limitations, regulations, or controls, national
emergencies, enemy or hostile governmental action, terrorism, insurrection, riots, civil disturbance or commotion, fire or other casualty, and other causes or events beyond their reasonable control.

Remedies

 

Upon validation of the claim by The Company, The Company will, at its discretion, either repair or replace the defective Product. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
